Entitled to Sick Pay
The Labour Court determined an employee was entitled to receive sick pay in relation to a road traffic accident which occurred outside the workplace. The employee claimed the employee handbook stated the company had discretion to make sick leave payments.
In overturning a previous decision of the labour relations commission in favour of the Company the Labour Court stated the sick leave policy scheme was ambiguous and confusing therefore the employee could not reasonably be expected to understand or interpret the policy.
