The Employment Appeals Tribunal has ruled employers are under no obligation to provide alternative work duties for employees returning to work following a period of absence from the workplace due to illness or injury. In defending a decision to dismiss an employee the company Tara Mines stated it was not possible to provide alternative work duties which did not involve the employee engaging in manual handling activities. In noting the employee’s own Doctor had not certified the employee as fit to return to work to resume manual handling duties, the Tribunal concluded the Company’s decision to dismiss the employee was reasonable in the circumstances, therefore the employee was not unfairly dismissed.
