The 2015 – “ACT”
The Workplace Relations Act which came into effect on the 1st of October 2015 is regarded as a game changer for employees and employers alike.
The new act will limit the time for an employee to submit a claim to six months from the date of an alleged contravention of employment law. Where a decision is made in favour of an employee the employer will have 56 days to settle the claim.
If an employer fails to settle a claim within the specified period an employee can make an application to the district court for an order to implement a decision of an adjudication officer.
The act provides for inspectors to issue on the spot fines of up to €2,000.00 for breaches of employment laws such as failing to provide employees with pay slips. Failure to implement a compliance notice can result in fines of up to €50,000.00 and or imprisonment.
Finally inspectors will have the power to enter workplaces and seize documents or records which they consider to be of interest.
