€137,000 High Court Award
The High Court awarded a 73 year old woman €137,000 in respect of injuries she sustained when she tripped over a deck chair which was left on a pedestrian isle walkway in a Dunnes Stores outlet in Cork. The woman’s legal team argued Dunnes Stores were in breach of their own Safety Statement which required pedestrian walkways and isles to be kept clear of obstruction at all times during opening hours. Dunnes Stores claimed in it’s defense the woman should have taken care to look where she was going.
However Mr. Justice Henry Abbot rejected the Company’s assertion stating Dunnes Stores were fully liable for her injuries and the woman who was previously very fit prior to the accident was now approaching feebleness and was in constant pain from a broken hip as a result of falling in the store.
