Mr. Justice Barr awarded a Dunnes Stores employee €64,020.00 for injuries he sustained when he tripped and fell down a stairs in the workplace.

The employee stated in evidence his foot caught on a loose step nosing causing him to loose his balance and fall down six steps of stairs.

On learning of the incident the Company’s HR Manager completed an Accident Report Form but did not inspect the stairs. The loose step nosing was subsequently repaired following the incident. An engineer who gave evidence on behalf of the employee stated the steps should have been inspected on a scheduled basis and when discovered the loose nosing should have been repaired as a matter of urgency.

Summarising Mr. Justice Barr was satisfied there was a defect in the step and that the employer had failed in his duty to provide the employee with a safe means of access and egress at his place of work.
