An employee who was involved in the manufacture of precast concrete curbs was struck by a electronically operated sensor arm which had no emergency stop mechanism attached.

In imposing a fine of €125,000 against the Company and a separate fine of €10,000 against the Company’s production line manager Mr. Justice Michael O’Shea stated the overall responsibility for the unfortunate death of the employee rested with his employer.

Commenting on the outcome of the case the assistant chief executive of the Health & Safety Authority said the fatal accident occurred as a direct consequence of a blatant disregard for safety which allowed employees to bypass safety control measures.
